In Poland, smoking cigarettes, e-cigarettes, and nicotine-free electronic cigarettes is banned in public places, including bus stops, on school grounds, and in restaurants. However, France has opted for a more radical solution: smoking tobacco products is also prohibited on beaches and in parks.

Infor.pl reports that , as of July 1, 2025, France has banned smoking on beaches, in parks, and within 10 meters of sports facilities, schools, and libraries. Currently, the ban does not apply to e-cigarettes and does not apply to terraces of restaurants and cafes.

The website explains that similar bans were previously in force in some municipalities in France, but since July they have been extended nationwide. Violations of the bans are punishable by fines ranging from €135 to €700.

As Infor.pl reminds, non-smokers have the right to live in an environment free from tobacco smoke, vapor from electronic cigarettes and other substances released by innovative tobacco products.

However, the legislature has not established a comprehensive, general ban on smoking cigarettes and e-cigarettes in public spaces. Pursuant to the Act on Health Protection against the Consequences of Using Tobacco and Tobacco Products, smoking tobacco products is prohibited:

  • on the premises of medical facilities, medical entities and in the premises of other facilities where health services are provided,
  • in the areas of organizational units of the education system and organizational units of social assistance,
  • on the university premises,
  • in workplace premises,
  • in the premises of cultural and recreational facilities for public use,
  • in catering and entertainment establishments,
  • in public passenger transport and in facilities serving passengers, at public transport stops,
  • in sports facilities,
  • in publicly accessible areas intended for children to play,
  • in other rooms available for public use.

There are numerous exceptions to this rule. Infor.pl lists that smoking is permitted in designated smoking areas:

  • in social welfare homes and retirement homes,
  • in 24-hour psychiatric wards (excluding wards with enhanced and maximum security conditions),
  • in hotels,
  • in facilities serving travelers, i.e. at railway stations and airports,
  • on the university premises,
  • in workplace premises and
  • in catering and entertainment establishments.

However, the owner of a catering and entertainment establishment may exempt one closed consumption room from the smoking ban if it is equipped with ventilation ensuring that tobacco smoke does not penetrate into other rooms.

Ban on the sale of e-cigarettes to minors

On July 5th, an amendment to the Tobacco Act, or the Act on Health Protection from the Consequences of Using Tobacco and Tobacco Products, came into force . The current Tobacco Act prohibits the provision of tobacco products, electronic cigarettes, or refill containers to persons under the age of 18. The amendment clarifies that electronic cigarettes also include those that do not contain nicotine.

As of July 5, nicotine-based and nicotine-free e-cigarettes are treated the same across the country . This means their use will be prohibited in the same places.

The amendment added nicotine pouches to the list of products prohibited for sale to persons under 18. Retailers will have six months to comply with the change and display a clear notice: "Sale of tobacco products, nicotine pouches, electronic cigarettes, or refill containers to persons under 18 years of age is prohibited." Furthermore, it was clarified that the nicotine content in nicotine pouches cannot exceed 20 mg/g.
