The Council of Ministers has adopted a draft amendment to the Labor Code and the Act on the Company Social Benefit Fund. Employers will be able to make a single transfer of unused leave, along with the final salary payment.
The Ministry of Family, Labor, and Social Policy's proposal links the payment date for vacation pay to the payment date for salary . This means that the payment will be made on the day the employee leaves work.
"If the payment of remuneration is made before the date on which the employment contract ends, the compensation will be paid within 10 days of the termination of the employment relationship . Previously, payment had to be made on the date of termination of the employment contract," we read in a statement published on the website of the Chancellery of the Prime Minister after the government meeting.
Furthermore, employers without company trade unions will be required to invite at least two employee representatives to discuss matters related to the company's social benefits fund. Previously, the participation of one representative was required, while labor law requires the presence of at least two employees . This solution aims to standardize the rules.
The project also envisages enabling electronic handling of matters between employees and employers.
- An employee will be able to submit an electronic application for, among other things, time off to deal with personal matters, unpaid leave, or the use of special systems or working time schedules - we read.
The new solutions are to enter into force 14 days after their publication in the Journal of Laws.
