The ban on the sale of e-cigarettes and nicotine sachets to minors is becoming a fact. President Andrzej Duda has signed an amendment to the act, which also covers nicotine-free products. The regulations will enter into force 14 days after publication in the Journal of Laws.
This concerns an amendment to the Act on the protection of health against the effects of using tobacco and tobacco products.
The amendment introduces a ban on the sale of all types of e-cigarettes and nicotine pouches to persons under 18 years of age. In stores where these products are available, the following information will appear: " Ban on the sale of tobacco products, nicotine pouches, electronic cigarettes or spare containers to persons under 18 years of age ".
The sale of nicotine-free e-cigarettes and nicotine pouches at a distance, including via the Internet, as well as their advertising, will be prohibited. Electronic cigarettes, refill containers and nicotine pouches will not be sold in vending machines.
In addition, nicotine-free e-cigarettes will be treated in the same way as products containing nicotine or tobacco - their use will be prohibited in places where smoking is prohibited, i.e. at public transport stops, in restaurants, on children's playgrounds and in schools.
It has been clarified that the nicotine content in a nicotine pouch cannot exceed 20 mg/g .
- The amendment (...) is necessary due to the urgent need to limit the use of electronic cigarettes by young people. These products pose a clear threat to public health, especially the young generation and non-smokers, which makes it necessary to introduce a ban on the sale of all types of electronic cigarettes and refill containers to persons under 18 years of age, regardless of whether the product contains nicotine or not - we read in the justification for the draft amendment.
The amendment to the Act will enter into force after 14 days from the date of its publication in the Journal of Laws.
